TERMS & CONDITIONS
Please read these Terms and Conditions carefully before confirming your booking. By paying your deposit or signing the Booking Form, you — as the Lead Guest — confirm that you have read, understood and agree to be bound by these Terms and Conditions on behalf of all members of your party. |
INTRODUCTION
Gozo Sunset Stay is a privately owned holiday farmhouse operated by an individual sole trader (the “Owner”). These Terms and Conditions govern all direct bookings made with the Owner for the rental of the property known as Gozo Sunset Stay, located at Ghajn Damma, Triq Marsalforn, ix-Xaghra, Gozo XRA 2702, Malta (the “Property”). References to “you” and “your” refer to the Lead Guest and all members of the party. References to “we”, “us” and “our” refer to the Owner.
The Owner is not a travel agent, tour operator, or package holiday provider. We do not arrange flights, transfers, or any other travel services on your behalf. This agreement relates solely to the rental of the Property for the dates confirmed in your Booking Confirmation.
1. BOOKING & CONFIRMATION |
1.1 Making a booking: A booking request is made by completing and submitting the Booking Form. By doing so, you confirm that all information provided is accurate and complete, and that you have read and accept these Terms and Conditions on behalf of your entire party.
1.2 Lead Guest: The Lead Guest must be aged 18 or over and accepts full legal and financial responsibility for the booking, including the conduct of all guests in the party.
1.3 Confirmation: Your booking is only confirmed once we have received your 30% deposit in full and issued a written Booking Confirmation. Until you receive confirmation, no contract exists between us. Please check your confirmation carefully and notify us immediately of any errors.
1.4 Accuracy of information: You are responsible for ensuring that all guest details, including names and the number of guests, are accurate at the time of booking. Any discrepancy may affect your booking.
1.5 Maximum occupancy: The Property has a maximum occupancy of 8 adult guests. No additional guests are permitted to stay overnight without prior written consent from the Owner. Breach of this condition may result in immediate termination of the booking without refund.
2. PAYMENT |
2.1 Booking deposit: A non-refundable deposit of 30% of the total accommodation cost is required upon booking to secure your dates. Your booking is not confirmed until this deposit is received.
2.2 Balance payment: The remaining 70% balance must be paid in full no later than 14 days before your arrival date. If full payment is not received by this date, we reserve the right to treat the booking as cancelled, in which case the deposit will be forfeited and the dates may be re-offered.
2.3 Payment method: All payments must be made by bank transfer to the account details provided on the Booking Form. Payment is only considered received when funds have cleared in full.
2.4 Security deposit: A refundable security deposit of €250 is payable in cash or by bank transfer on arrival at the Property. This deposit will be returned in full following a satisfactory inspection of the Property at checkout. Any deductions made will be communicated in writing with supporting evidence.
2.5 Eco Tax: Until 30 June 2026, €0.50 per adult per night, capped at a maximum of 5 nights, is payable in cash only on arrival at the Property, in accordance with Maltese Government requirements. From 1 July 2026, this changes to €1.50 per night per guest aged over 18, capped at a maximum of €22.50 per continuous visit (previously capped at €5.00).
2.6 Late payment: If the balance payment is not received by the due date, we reserve the right to cancel the booking and retain the deposit. We will attempt to notify you before taking such action.
3. CANCELLATION BY YOU |
You may cancel your booking at any time by giving written notice to the Owner. Cancellations take effect from the date we receive your written notification. The following cancellation charges apply:

We strongly recommend that all guests take out comprehensive travel insurance, including cover for trip cancellation, curtailment, illness, travel disruption, and personal liability, before confirming their booking.
4. CHANGES TO YOUR BOOKING |
4.1 If you wish to change your booking dates or other details after confirmation, please contact us in writing as soon as possible. We will do our best to accommodate your request, but changes are subject to availability and cannot be guaranteed.
4.2 Where a change results in a lower total booking value, no refund will be issued for the difference. Where a change results in a higher value, the additional amount must be paid before the change is confirmed.
4.3 Requests to transfer a booking to a different person may be considered at our discretion. Any transfer is subject to a minimum 7 days’ written notice and may incur an administration charge.
5. CHANGES OR CANCELLATION BY THE OWNER |
5.1 We will make every effort to provide the Property as booked. In the unlikely event that we are required to make a significant change to or cancel your booking (for example, due to circumstances beyond our reasonable control), we will notify you as soon as possible.
5.2 In the event of a cancellation by us for reasons other than force majeure, we will offer you a full refund of all monies paid, or, where possible, the option to rebook at an alternative date.
5.3 We reserve the right to terminate a booking without refund if guests are found to be in serious breach of these Terms and Conditions or the House Rules, including but not limited to: causing damage to the Property, persistent breach of quiet hours, or exceeding the maximum occupancy.
6. PRICING & ACCURACY |
6.1 We take all reasonable steps to ensure that pricing information is accurate at the time of booking. In the event of an obvious pricing error on our part, we reserve the right to contact you to correct the error or cancel the booking with a full refund.
6.2 The nightly rate quoted at the time of booking is fixed and will not be subject to change once a Booking Confirmation has been issued, except where required by law (for example, changes to the Maltese eco tax rate).
7. CHECK-IN & CHECK-OUT |
Check-in: From 3:00pm on your arrival date. If you anticipate arriving after 8:00pm, please inform us in advance so that appropriate arrangements can be made.
Check-out: By 11:00am on your departure date. Late check-out may be available by prior written arrangement only and may be subject to an additional charge.
ID requirement: On arrival, all adult guests are required to present a valid Passport or Government-issued photographic identification for registration purposes.
8. GUEST RESPONSIBILITIES |
The Lead Guest accepts responsibility for the following on behalf of all members of the party:
- Ensuring all guests comply with these Terms and Conditions and the House Rules at all times.
- Any damage, breakages, missing items, or requirement for exceptional cleaning during or following the stay.
- Reporting any damage or maintenance issues to the Owner as soon as they are discovered.
- Leaving the Property in a clean, tidy, and undamaged condition upon departure.
- Ensuring the number of guests at the Property does not exceed the agreed maximum at any time.
- The conduct and behaviour of all guests, including any minors, throughout the duration of the stay.
9. HOUSE RULES |
The following rules apply at all times during your stay. Breach of these rules may result in immediate termination of the booking without refund.
- Noise & quiet hours: No loud music, parties, events, or gatherings causing noise disturbance are permitted at any time. Quiet hours are strictly observed between 22:00 and 07:00. The Property is located within a residential area and the Owner is committed to being a respectful neighbour.
- No pets: No animals or pets of any kind are permitted on the Property at any time. This is a strict no-pet property.
- No smoking: Smoking is strictly prohibited inside the Property. Guests who wish to smoke must do so in designated outdoor areas only.
- Maximum occupancy: The number of guests staying at the Property must not exceed 8 adults. No additional overnight visitors are permitted.
- Towels and linen: Bath towels and bed linen must not be used for makeup removal, fake tan application, or poolside use. Pool towels are provided separately for outdoor and poolside use.
- Recycling and waste: Guests must comply with the refuse and recycling policy as clearly displayed at the Property. Bins must be placed outside on the correct collection day.
- Lights and air conditioning: All lights and air conditioning units must be switched off when leaving the Property.
- Damage: Any damage, breakages, or losses must be reported to the Owner immediately.
10. POOL & SAFETY |
- Guests use the pool entirely at their own risk. The Owner accepts no liability for accidents or injuries occurring in or around the pool area.
- Children must be supervised by a responsible adult at all times when near or in the pool. The Owner is not responsible for the supervision of children.
- No diving, running, or unsafe behaviour in or around the pool area is permitted.
- No glassware of any kind is permitted in or around the pool area at any time.
- Pool hours are 7:00am to 10:00pm. Use of the pool outside these hours is not permitted.
11. UTILITIES & FAIR USE |
11.1 Electricity and water are included within normal and reasonable usage. A credit is provided for air conditioning use during your stay, which is usually sufficient for normal use. If additional credit is required, guests may top up the meter with €1.00 coins.
11.2 Excessive or wasteful consumption — including but not limited to leaving air conditioning running with windows or doors open, or leaving appliances on unnecessarily — may result in additional charges at the Owner’s discretion.
11.3 Guests must switch off all air conditioning units when leaving the Property, whether for a short excursion or at checkout.
12. SECURITY DEPOSIT & DAMAGES |
12.1 The €250 security deposit is held as cover for any damages, breakages, missing items, misuse of facilities, or exceptional cleaning costs arising from your stay, beyond normal wear and tear.
12.2 The security deposit will be refunded within 48–72 hours of your departure, subject to a satisfactory inspection of the Property.
12.3 Any deductions from the security deposit will be communicated to you in writing with supporting photographic evidence before the deduction is made.
12.4 Where the cost of damages or losses exceeds the security deposit, the Owner reserves the right to charge the additional amount to the card details provided on the Booking Form. You will be notified in writing with evidence before any such charge is made.
13. WATER SPORTS & OFF-SITE ACTIVITIES |
13.1 Any activities arranged through or recommended by the Owner — including but not limited to jet skiing, boat trips, kayaking, diving, or cycling — are undertaken entirely at the guest’s own risk.
13.2 Such activities are provided by independent third-party operators and are subject to the terms and conditions of those operators. The Owner accepts no liability whatsoever for any accident, injury, loss, or damage arising from off-site activities.
13.3 Guests are responsible for ensuring they have adequate personal travel or activity insurance to cover any such activities.
14. LIABILITY |
The Owner accepts no responsibility or liability for the following:
- Loss, theft, or damage to personal belongings, vehicles, or valuables at the Property.
- Personal accidents or injuries sustained at the Property or off-site, except where caused directly by the Owner’s proven negligence.
- Travel disruptions, flight cancellations or delays, ferry disruptions, or failure to arrive at the Property.
- Power cuts, water outages, internet disruptions, or infrastructure failures beyond the Owner’s reasonable control.
- Any issue or disruption caused by neighbouring properties, local construction, public events, or other circumstances outside the Owner’s control.
Guests are responsible for securing all doors, windows, and personal valuables at all times during the stay. The Owner’s maximum liability in any circumstance shall not exceed the total amount paid by you for the booking.
15. DATA PROTECTION & PRIVACY |
15.1 The personal information you provide when making a booking will be used solely for the purposes of administering your stay, including processing payment, complying with Maltese legal requirements (including tourist registration obligations), and communicating with you in relation to your booking.
15.2 Your data will not be shared with third parties except where required by law or for the purpose of processing your payment.
15.3 By making a booking, you consent to your personal data being processed for these purposes.
16. FORCE MAJEURE |
The Owner shall not be liable for any failure to fulfil obligations under this agreement where such failure arises from events outside their reasonable control that could not have been foreseen or avoided, including but not limited to: severe weather events, natural disasters, fire, acts of terrorism, war, government restrictions, public health emergencies, utility failures, or any other event constituting force majeure under Maltese law.
In the event of force majeure, the Owner will endeavour to offer an alternative date or a full or partial refund at their discretion, depending on the circumstances. The Owner shall not be liable for any additional costs, losses, or expenses incurred by you as a result of force majeure.
17. COMPLAINTS & DISPUTES |
17.1 If you experience any problem during your stay, please report it to the Owner immediately via WhatsApp or telephone at +356 7958 8773 or +44 77841 80442. The Owner will make every reasonable effort to resolve the issue promptly.
17.2 Complaints not raised during the stay will be difficult to investigate and resolve. Failure to report an issue at the time may affect your ability to seek any remedy after departure.
17.3 Any formal complaint following departure must be submitted in writing to info@gozosunsetstay.com within 14 days of the end of your stay. The Owner will respond in writing within 28 days of receipt.
18. GOVERNING LAW & JURISDICTION |
These Terms and Conditions, and any dispute or claim arising from or in connection with them or your booking, shall be governed by and construed in accordance with the laws of Malta. Both parties agree to submit to the exclusive jurisdiction of the Maltese courts in relation to any such dispute.
